Kerala Toddler Arshith Death: Audio Reveals Ignored Warnings and Institutional Failure

Nedumangad,Thiruvananthapuram: A shocking investigation by The News Minute has revealed that nearly a month before 20-month-old Arshith died from prolonged physical abuse, his grandmother, Reena, repeatedly warned authorities that the child was in danger. A 16-minute audio recording obtained by the publication shows Reena contacting the Thiruvananthapuram District Child Protection Unit (DCPU) on 3 May 2026, expressing serious concerns that the child had suffered suspicious injuries and may have been abused by his stepfather, Ashkar.  

According to the report, Reena pointed out that Arshith had fractures in both arms and questioned the explanation that he had merely fallen from a toy bicycle. She also informed officials about previous threats allegedly made by Ashkar. However, instead of initiating an immediate welfare check or child protection intervention, the DCPU official reportedly expressed skepticism and suggested that her concerns might be based on assumptions or family disputes. No field visit or verification was conducted.  

On 29 May 2026, Arshith died after allegedly enduring sustained abuse. Post-mortem findings reportedly revealed extensive injuries, including fractured ribs, burn marks, damaged skin, and other signs of repeated violence. Police subsequently arrested both Ashkar and the child’s mother, Akhila, alleging that while Ashkar inflicted the abuse, Akhila failed to protect the child.  

The investigation further raises concerns regarding multiple institutional failures. Despite the child being treated at hospitals for serious fractures and despite complaints being made to both police and child protection authorities, no effective protective intervention occurred before his death. Experts interviewed by TNM stated that the DCPU should have conducted an immediate inquiry and, if abuse was suspected, produced the child before the Child Welfare Committee (CWC). 

Legal significance 

The death of Arshith raises serious concerns regarding the effectiveness of child protection mechanisms in Kerala. The reported audio evidence suggesting that warnings were communicated to child protection authorities before the child’s death highlights the importance of timely intervention when allegations of child abuse are brought to the attention of public authorities. 

The case also underscores the legal and constitutional duty of the State to protect children from violence, abuse, and neglect. It draws attention to the need for effective coordination among police, hospitals, Child Welfare Committees, District Child Protection Units, and other child welfare institutions to ensure that vulnerable children receive immediate protection when risks are identified. 

More broadly, the incident may prompt scrutiny of institutional responses to child abuse complaints and reinforce the need for greater accountability, stronger monitoring mechanisms, and a child-centred approach in implementing the Juvenile Justice (Care and Protection of Children) Act, 2015.
