Perambra MLA Fathima Thahliya Warns Against Privacy Violations and Unauthorized Recording 

Kozhikode: Perambra MLA Fathima Thahliya publicly warned against the unauthorized recording and circulation of videos that allegedly intrude into her personal privacy. Through a social media statement, she expressed concern that certain individuals, claiming to be media personnel, were recording her personal interactions and private moments without authorization and sharing them online in a misleading manner. She emphasized that even public figures retain a right to privacy and stated that continued violations could result in legal action. The MLA also clarified that such unofficial channels have no connection with her public relations activities and criticized the practice of sensationalizing ordinary interactions for online engagement and profit. 

Legal significance 

This incident raises important concerns regarding the protection of individual privacy in the digital age. The Right to Privacy has been recognized as a fundamental right under Article 21 of the Constitution of India by the Supreme Court in the Justice K.S. Puttaswamy v. Union of India judgment. Therefore, unauthorized recording and dissemination of a person’s private activities may amount to an unlawful invasion of privacy. 

Where electronic devices are used to capture or circulate personal information without consent, Section 66E of the Information Technology Act, 2000 (Violation of Privacy) may become relevant. If the conduct involves repeated monitoring, following, or online surveillance of an individual despite objections, Section 78 of the Bharatiya Nyaya Sanhita, 2023 (Stalking) may also be attracted. 

The incident highlights the need to balance freedom of expression and media reporting with the constitutional right to privacy, dignity, and personal autonomy of individuals, including public representatives.
