Legal Significance
The incident raises serious concerns regarding the safety of women in public spaces and the criminal consequences of harassment, intimidation, and unlawful pursuit. If the allegations are substantiated, the conduct of following and repeatedly pursuing a woman against her will may attract Section 78 of the Bharatiya Nyaya Sanhita, 2023 (Stalking). Any use of force, threats, or attempts to physically harm the victim may also invoke provisions relating to assault and criminal force against a woman.
Further, if the acts were intended to outrage the woman’s modesty or cause fear and intimidation, authorities may examine offences under Section 74 BNS, 2023 (Assault or Criminal Force to Woman with Intent to Outrage Her Modesty) and Section 351 BNS, 2023 (Criminal Intimidation). The case also demonstrates the importance of prompt police intervention and emergency response mechanisms in preventing potential offences against women.
