Assault Accused Allegedly Continues to Threaten Complainant from Jail 

Kasaragod: A woman who had previously lodged a complaint in an assault case has alleged that the accused continues to threaten and intimidate her despite being in judicial custody. According to the complainant, threatening communications and pressure tactics have persisted through intermediaries even after the accused was remanded to jail. She has approached the authorities seeking additional protection and action against those allegedly involved in intimidating her. Police are examining the allegations and investigating whether any further offences have been committed while the accused remains in custody.

The case highlights the legal protection afforded to victims and witnesses during the pendency of criminal proceedings. If an accused person, either directly or through intermediaries, threatens a complainant in order to influence testimony, withdraw a complaint, or obstruct the course of justice, such conduct may constitute criminal intimidation under Section 351 of the Bharatiya Nyaya Sanhita, 2023 (BNS). Where threats are intended to deter a person from cooperating with law enforcement or judicial authorities, the conduct may also be relevant in bail proceedings and could justify cancellation of bail or stricter custodial measures.
