Kollam: A 23-year-old man was arrested in Kadakkal, Kollam, after police registered a case regarding the alleged sexual abuse of a minor girl. According to the investigation, the child was allegedly lured with sweets and other gifts and taken to the accused’s residence, where she was subjected to repeated abuse. Police have also named a second accused, who is currently absconding, and efforts are underway to locate him.
The matter came to light when a relative of the child reportedly noticed the abuse and informed Childline authorities. Following the information received from Childline, the police conducted an inquiry and arrested the first accused. Authorities have stated that the child is receiving counselling and support services to assist in her recovery.
Legal Significance
The allegations involve offences against a minor and therefore attract the provisions of the Protection of Children from Sexual Offences (POCSO) Act, 2012, which provides stringent punishment for sexual assault, aggravated sexual assault, and sexual abuse of children. Depending on the evidence established during investigation, provisions relating to penetrative sexual assault (Sections 3 and 4) or aggravated penetrative sexual assault (Sections 5 and 6) may become applicable. The POCSO Act also mandates child-friendly investigation and trial procedures to protect the interests of the victim.
In addition, relevant provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS) concerning sexual offences against children may be invoked wherever applicable. The case highlights the legal obligation of authorities to ensure prompt investigation, rehabilitation of child victims, and prosecution of offenders. It also underscores the important role played by Childline, family members, and community reporting mechanisms in detecting and preventing child sexual abuse.
