Woman Abducted and Sexually Assaulted in Kochi; Kollam Native Arrested 

Kochi,Ernakulam: A 24-year-old woman was allegedly abducted and sexually assaulted in Kochi. According to the police, the accused allegedly threatened the woman using her private visuals before forcibly taking her away in a car. It is further alleged that the woman was administered an intoxicating substance and subsequently subjected to sexual assault. Based on the victim’s complaint, the police registered a case and launched an investigation.  

The accused, a native of Kollam who is reportedly involved in several other criminal cases, was arrested by the Kochi North Police. The investigation is continuing to ascertain the full circumstances surrounding the offence and to gather additional evidence relevant to the prosecution.  

Legal Significance 

The allegations disclose several serious offences under the Bharatiya Nyaya Sanhita, 2023 (BNS). The act of forcibly taking the victim may attract provisions relating to kidnapping/abduction (Sections 137 and 140 BNS), while the allegation of sexual assault may invoke Section 64 BNS (Punishment for Rape). If it is established that the victim was administered an intoxicating substance to facilitate the commission of the offence, the relevant provisions concerning causing a person to consume stupefying or intoxicating substances for committing an offence may also be attracted.  

Further, the alleged use of private visuals to threaten the victim may constitute criminal intimidation under Section 351 BNS and could also attract provisions relating to violations of privacy and electronic evidence, depending on the manner in which the images or videos were obtained, possessed, or used. The case highlights the legal consequences of using coercion, intimidation, and incapacitation to commit sexual offences and underscores the importance of prompt police intervention and victim protection measures under Indian criminal law.
