Woman Alleges Inappropriate Touch by Police Officer During Family Dispute Intervention

Woman Alleges Inappropriate Touch by Police Officer During Family Dispute Intervention

Kozhikode: A woman in Kozhikode has alleged that a police officer, who was part of a team that arrived to intervene in a family dispute, deliberately touched her inappropriately during the course of official duties. Following the complaint, the matter was brought to the attention of senior police authorities. A preliminary inquiry was reportedly conducted, and departmental action against the concerned officer was initiated.

The incident has generated public concern because the allegations involve a police officer acting in an official capacity. The complaint raises questions regarding professional conduct, accountability of public servants, and the duty of law-enforcement personnel to act with fairness, dignity, and respect while dealing with members of the public, particularly women.

Legal Significance

If the allegations are found to be true, the conduct may attract provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS) relating to offences against the dignity and bodily autonomy of women. Depending on the facts established during investigation, provisions concerning the use of criminal force or assault against a woman with intent to outrage her modesty may become relevant. Since the accused is alleged to have been acting in an official capacity, the matter may also constitute misconduct by a public servant, attracting departmental disciplinary proceedings in addition to any criminal prosecution.

The case also highlights the constitutional obligation of law-enforcement agencies to protect the dignity and privacy of individuals under Article 21 of the Constitution of India. Allegations of misconduct by police personnel are treated seriously because public confidence in the criminal justice system depends upon the integrity and professionalism of law-enforcement officers. Where prima facie evidence exists, authorities may initiate both criminal investigation and departmental proceedings to ensure accountability and maintain public trust in policing institutions.

Action to be Taken

In cases involving alleged misconduct by police personnel, the victim should immediately submit a written complaint to the District Police Chief, City Police Commissioner, or other competent supervisory authority. Any available evidence, including witness statements, CCTV footage, call records, photographs, or other relevant material, should be preserved and produced during the inquiry. If the allegations disclose a cognizable offence, a criminal case should be registered and investigated independently.

Apart from criminal remedies, the complainant may also approach the State Police Complaints Authority or the appropriate District Police Complaints Authority seeking an impartial inquiry into the conduct of the officer concerned. Authorities should ensure a prompt, transparent, and unbiased investigation so that both the rights of the complainant and the principles of due process are protected. Where misconduct is established, appropriate disciplinary and legal action should follow to prevent recurrence of similar incidents.
