Woman Alleges Assault, Criminal Intimidation by Husband and Associates in Kochi 

Kochi,Ernakulam: A woman residing in an apartment at Mambra in Karumaloor alleged that her husband, along with four other persons, forcibly entered her flat during the early hours of 13 June 2026 and subjected her to physical assault, intimidation and mental harassment. According to the complaint, the accused questioned her regarding a suspected extramarital relationship, pulled her from bed, snatched her mobile phone, slapped and pushed her, and continued the alleged assault after she sought refuge in a bathroom.  

The complainant further alleged that the accused recorded videos of her and threatened to circulate the footage to damage her reputation. She also stated that she was subjected to verbal abuse and threats to her life. Based on the complaint, the Aluva West Police registered a case against five persons and commenced an investigation into the allegations.  

Legal Significance 

The allegations, if established during investigation, may attract several provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS). The acts of entering the woman’s residence without authority may constitute house-trespass (Sections 329–331 BNS, depending on the circumstances). The alleged acts of slapping, pushing and physically attacking the complainant may amount to voluntarily causing hurt (Section 115 BNS), while the use of abusive conduct and intimidation may attract criminal intimidation (Section 351 BNS). If multiple persons acted together pursuant to a common intention, the principle of common intention under Section 3(5) BNS may also become relevant. 

Further, the alleged recording of videos and threats to circulate them could attract provisions relating to voyeurism and violation of a woman’s privacy, depending on the nature of the recordings and evidence collected during investigation. If electronic devices were used to create, store or disseminate such content, provisions of the Information Technology Act, 2000, particularly those dealing with the transmission or publication of private or sexually explicit material in electronic form, may also be examined by the investigating agency. The exact charges will depend upon the evidence gathered during the course of investigation.  

Action to Be Taken 

The police should conduct a prompt and impartial investigation by recording the detailed statement of the complainant, collecting CCTV footage from the apartment complex, securing mobile phones and other electronic devices allegedly used in the incident, and identifying all persons involved. Any videos or digital evidence allegedly recorded during the occurrence should be preserved through proper forensic procedures to prevent tampering and to establish authenticity. 

If sufficient evidence is found, the investigating officer should proceed with the arrest or other lawful measures against the accused persons and file a final report before the jurisdictional court. Simultaneously, the complainant may be informed of her rights under the Protection of Women from Domestic Violence Act, 2005, including the possibility of seeking protection orders, residence orders, monetary relief and other remedies through the competent Magistrate, apart from the ongoing criminal proceedings.
