Tragic Abduction, Rape, and Murder of a Minor girl in Delhi 

Delhi: In a horrific incident in South Delhi, a minor girl was abducted, raped, and murdered by an online taxi driver identified as Bablu. The child was sleeping on a footpath with her family when the perpetrator, who was reportedly under the influence of alcohol, kidnapped her. Despite the father’s desperate attempts to chase the vehicle after hearing his daughter’s cries for help, the accused managed to escape. Police utilized CCTV footage, GPS data, and trip information from the taxi company to trace the vehicle to the Vikaspuri area in West Delhi. The accused confessed to taking the girl to a secluded spot near the Gurugram-Faridabad road, where he committed the crimes before abandoning her body. The suspect, who has a criminal record in Bihar, was arrested after a confrontation with police during which he attempted to flee. 

Legal Significance  

This case invokes the stringent provisions of the Protection of Children from Sexual Offences (POCSO) Act, 2012. Specifically, under Section 6 of the POCSO Act, the aggravated sexual assault of a minor is punishable by rigorous imprisonment for a term not less than 20 years, which may extend to imprisonment for life (meaning the remainder of the natural life of the convict) or the death penalty. Furthermore, under the Bharatiya Nyaya Sanhita (BNS), the accused faces charges for kidnapping or abducting with intent to secretly and wrongfully confine a person (Section 137) and murder (Section 103), which carries a minimum penalty of life imprisonment or death, along with a fine. 

Beyond the individual criminal prosecution, this case raises significant legal concerns regarding the liability of digital platforms and service providers. The investigation into how an individual with a prior criminal history was hired by the taxi service highlights the potential legal implications for companies regarding background verification failures, duty of care, and negligence in ensuring passenger and public safety. 

Action to be Taken  

Immediate and rigorous legal action must be initiated against the accused through a fast-track court process to ensure swift justice. The authorities must conduct a thorough investigation to establish a watertight case, ensuring that all forensic evidence and witness statements are properly documented for trial. 

Simultaneously, the administration must hold the taxi service provider accountable. Regulatory authorities should issue strict directives and initiate legal proceedings against the company for potential lapses in their hiring process and mandatory background check protocols. Furthermore, proactive steps must be taken to enhance security measures for vulnerable populations living on the streets, ensuring better surveillance and police presence in areas prone to such risks to prevent future tragedies.
