Maharashtra Assembly Data Shows Rise in Rape Cases and Crimes Against Women

Maharashtra: Data presented before the Maharashtra Legislative Assembly indicates an increase in reported rape cases and other crimes against women in the state during 2025 compared to the previous year. The figures reveal that thousands of women were affected by various forms of gender-based violence, including rape, molestation, domestic violence, and other offences. The issue was raised in the Assembly, drawing attention to the need for stronger preventive measures and more effective law-enforcement responses.  

The state government stated that the rise in registered cases may be attributable not only to criminal incidents but also to improved reporting mechanisms, increased public awareness, easier access to complaint registration, and enhanced policing measures. Nevertheless, the data underscores the continuing challenge of ensuring the safety and security of women and girls across the state.  

Legal Significance 

The increase in rape cases and crimes against women highlights the continuing relevance of the legal protections available under the Bharatiya Nyaya Sanhita, 2023 (BNS). In cases involving sexual assault, the relevant provisions may include Section 63 (Rape) and Section 64 (Punishment for Rape). Depending on the facts of a particular case, provisions relating to sexual harassment, assault or criminal force against a woman, stalking, voyeurism, criminal intimidation, and domestic violence-related offences may also be invoked. Where the victim is a child, the provisions of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) become applicable.  

The data also emphasizes that legal protection alone is insufficient unless accompanied by effective investigation, timely prosecution, victim support services, and meaningful conviction rates. The constitutional guarantee of equality, dignity, and personal liberty under Articles 14, 15, and 21 of the Constitution of India imposes an obligation on the State to create a safe environment for women. Rising crime figures serve as an indicator for policymakers and law-enforcement agencies to review existing preventive mechanisms and strengthen institutional responses to gender-based violence.  

Action to be Taken 

Authorities should strengthen measures for the prevention and investigation of crimes against women by increasing police patrolling in vulnerable areas, improving street lighting, expanding CCTV coverage, enhancing cyber-monitoring capabilities, and ensuring prompt registration of First Information Reports (FIRs). Fast-track investigation and prosecution of serious offences, particularly rape and child sexual abuse cases, should be prioritized to improve public confidence in the justice system.  

In addition, governments and local authorities should focus on public awareness programmes, gender-sensitization initiatives, self-defence training, victim counselling services, and accessible reporting mechanisms. Women should be encouraged to report offences without fear of stigma or retaliation, while support systems such as women help desks, one-stop crisis centres, legal aid services, and victim compensation schemes should be strengthened to provide comprehensive assistance to survivors.
