New Delhi: The Supreme Court began examining a set of cases concerning the marital-rape exception. The court decided to first hear an appeal arising from a Karnataka case involving allegations that a husband treated his wife as a “sex slave”. Justice Joymalya Bagchi said marriage does not extinguish an individual’s autonomy, while the court considers the legal and constitutional questions surrounding prosecution for rape within marriage.
Action to Be Taken
Women facing sexual violence within marriage should have access to legal advice, protection and support services, irrespective of their marital status.
