Witness Mistakenly Portrayed as Drug Accused in Kochi Excise Case

Ernakulam: A controversy erupted in Kochi after the Excise Department allegedly released visuals that portrayed a woman witness as an accused in a chemical drug case. The woman, who works as a manager at a private hotel in Cheranelloor, appeared in footage recorded during a drug raid conducted on June 5. Although three individuals were arrested and narcotic substances and cash were seized, the manager was only a witness and not an accused. After the footage circulated, many people wrongly assumed she was involved in the crime, reportedly causing problems for her and her family. She subsequently filed complaints with the Excise Deputy Commissioner and the Kochi City Police Commissioner seeking to clear her name. 

Legal Significance 

This case highlights the importance of the presumption of innocence and the duty of law-enforcement agencies to avoid releasing information that may wrongly identify innocent persons as accused individuals. It also raises issues relating to the right to reputation and privacy under Article 21 of the Constitution, as an incorrect portrayal by authorities can cause serious personal, social, and professional harm.
