Actor Assault Case Legal Updates (Ernakulam / High Court)

Ernakulam: A Division Bench of the Kerala High Court (comprising Justices Raja Vijayaraghavan V. and K. V. Jayakumar) rejected sentence suspension pleas filed by convicts C. Pradeep (A-6) and Saleem alias Vadival Salim (A-5) in the 2017 actor abduction and sexual assault case. The duo had challenged their 20-year rigorous imprisonment sentence awarded by the Ernakulam Principal District and Sessions Court in December 2025, claiming they played no active role in the conspiracy. Dismissing their petitions, the High Court observed that prima facie evidence clearly proves a coordinated criminal conspiracy among the accused, who executed their plan with precise timing. The bench emphasized that the grave nature of the offense struck directly at the dignity, bodily autonomy, and sense of security of women, finding no patent infirmity in the trial court’s conviction to justify releasing them on bail pending appeal. 

Action to be Taken 

The prosecution and legal counsel representing the survivor should present comprehensive trial court records, digital forensic evidence (such as cell tower locations and vehicle logs), and Test Identification Parade reports before the appellate bench to oppose bail or sentence suspension requests. If a convicted party seeks suspension of execution of sentence under Section 430 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), the State or victim’s legal team can highlight prior criminal antecedents, risk of witness intimidation, and the overall gravity of the offense to ensure sentence suspension is denied.
