Housewife Alleges Sexual Assault Attempt by Pastor Associated with Elohim Global Worship Centre

Pathanamthitta: A housewife from Pathanamthitta has alleged that a pastor, identified as an assistant to the head of the Elohim Global Worship Centre, attempted to sexually assault her after visiting her residence under the pretext of conducting a prayer service. According to the complainant, she became acquainted with the pastor through the religious organisation, after which he visited her home for prayer. She alleged that, following the visit, he made sexually inappropriate advances and attempted to coerce her into establishing a sexual relationship. She has stated that a complaint has already been lodged with the police.  

The allegations emerge at a time when the Elohim Global Worship Centre has already been under official scrutiny in connection with separate allegations involving abuse and exploitation of inmates. The present complaint is being treated as an independent matter, and the police are expected to verify the allegations by recording witness statements, examining available evidence, and conducting a fair investigation before taking further legal action.  

Legal Significance 

If the allegations are substantiated through investigation, the conduct may attract provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS). Depending on the evidence, Section 75 (Sexual Harassment) may apply where unwelcome sexually coloured remarks, advances, or demands for sexual favours are established. If there was an attempt to use criminal force with the intention of outraging the modesty of the woman, Section 74 BNS (Assault or criminal force to woman with intent to outrage her modesty) may also be invoked. Where intimidation or threats were allegedly used to silence or coerce the complainant, Section 351 BNS (Criminal Intimidation) may also become relevant. The precise offences ultimately invoked will depend upon the facts established during the investigation.  

The case also underscores that individuals holding positions of religious or social influence are equally subject to criminal law and cannot claim immunity from investigation. 

Action to be Taken 

The police should promptly register and investigate the complaint in accordance with the BNSS, if the information discloses a cognizable offence. The victim’s statement should be recorded at the earliest, and investigators should collect all relevant evidence, including electronic communications, call records, CCTV footage (if available), and statements of witnesses who may corroborate the allegations. If sufficient evidence is found, the appropriate provisions of the BNS should be invoked and the accused produced before the competent court in accordance with law. 

The authorities should also examine whether there is any pattern of similar complaints involving the institution or its functionaries and provide appropriate protection and counselling to the complainant, where necessary. Religious and charitable institutions should adopt safeguarding policies, grievance redressal mechanisms, and background verification procedures for persons interacting with devotees, thereby helping to prevent abuse of trust and ensuring accountability within such organisations.
