Kochi:The Kerala High Court held that sexual intercourse with a girl below 18 years can constitute an offence under the POCSO Act even if she is claimed to be the accused person’s wife. The court rejected a 27-year-old man’s plea seeking to quash criminal proceedings arising from a case registered in Mannarkkad, Palakkad. The court said POCSO provisions prevail where they conflict with other laws and that marriage does not remove criminal liability when the girl is under 18.

Cases involving minors should be investigated under applicable child-protection laws, with the child’s safety and welfare given priority.
