Kerala High Court Upholds Conviction in POCSO Sexual Assault Case 

On 31 July 2026, the Kerala High Court upheld the conviction in a case under the Protection of Children from Sexual Offences (POCSO) Act, ruling that forcibly placing a vibrating device on a child’s genital area amounts to penetrative sexual assault as defined under the law. The Court observed that the use of an object to sexually violate a child falls within the scope of penetrative sexual assault under the POCSO Act, regardless of whether there is direct physical penetration by a body part. By dismissing the appeal and affirming the conviction, the High Court reinforced the objective of the POCSO Act to provide comprehensive protection to children from all forms of sexual abuse and exploitation. 

Action to be Taken: 

Authorities should ensure the strict and consistent enforcement of the POCSO Act by conducting prompt, child-friendly, and impartial investigations in all cases involving sexual offences against children. Law enforcement agencies, prosecutors, and the judiciary should receive regular training on child-sensitive procedures to minimize trauma to survivors during the investigation and trial. Survivors should be provided with immediate medical care, psychological counselling, rehabilitation services, and legal assistance.
