Kozhikode Teenager Rescued After 36-Day Abduction and Sexual Assault 

Kozhikode: A minor girl, who had been missing from the Chevayur police station limits in Kozhikode since May 15, 2026, was rescued by the police after 36 days of captivity. The investigation revealed that the girl had been abducted from outside her home by an Instagram acquaintance and his accomplice, who arrived in a car at night. Following a secret tip-off, police surrounded a building in Kolavallur, Kannur, and successfully rescued the victim. Although a five-member gang fled just before the police arrived, authorities have registered a case against seven individuals involved in the abduction and illegal confinement. The victim has reported that she was sexually assaulted during her period of captivity. She has since been presented before the Child Welfare Committee (CWC). 

Legal Significance 

This incident mandates the application of the Protection of Children from Sexual Offences (POCSO) Act, 2012. Specifically, the act of sexual assault on a minor attracts Section 4 (punishment for penetrative sexual assault) or Section 6 (aggravated penetrative sexual assault, given the involvement of multiple persons). Additionally, the abduction and confinement of the minor fall under Section 16 of the POCSO Act, which deals with punishment for kidnapping or abducting a child for the purpose of sexual assault. Because the victim is a minor, the POCSO Act overrides general penal statutes, ensuring a victim-centric trial process and mandatory reporting requirements. 

Furthermore, the case invokes the Bharatiya Nyaya Sanhita (BNS). Section 137 (kidnapping or abducting in order to subject person to grievous hurt or slavery) and Section 64 (punishment for rape) are applicable, with Section 70 (gang rape) specifically invoked due to the involvement of multiple perpetrators. 

Action to be Taken 

The immediate priority for law enforcement is the apprehension of the seven suspects, including the five who escaped from the Kolavallur location. The police must accelerate the collection of forensic evidence, including medical examinations of the victim and digital forensic analysis of the social media communications (Instagram) that facilitated the crime, to ensure a robust charge sheet is filed within the mandatory timeframe. 

Simultaneously, the CWC must provide comprehensive support to the survivor, including counselling and trauma-informed care. As the case progresses, the prosecution must ensure the victim’s protection from intimidation and stress during court proceedings. Authorities should also conduct community-level awareness programs regarding the risks associated with online interactions with strangers to prevent similar instances of child exploitation in the future.
