Minor Girl Sexual Assault Case: Accused Arrested in Palakkad

Palakkad: A man was arrested in Palakkad district after allegations of sexually assaulting a minor girl. According to the complaint, the accused allegedly lured the child by offering clothes and subsequently subjected her to sexual abuse. The child reportedly raised an alarm and managed to escape from the location before informing her family about the incident. 

Following the complaint lodged by the survivor’s family, the police registered a case and conducted an investigation, leading to the arrest of the accused on the same night. Reports also indicate allegations that the complainant’s family was threatened after the incident. Further investigation is underway. 

Legal Significance 

The case involves an alleged sexual offence against a minor and therefore attracts the provisions of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act). Depending on the nature of the act established, the provisions of Section 7 (Sexual Assault) and Section 8 (Punishment for Sexual Assault) may apply. If the facts disclose a more serious form of sexual assault, the provisions relating to Aggravated Sexual Assault (Sections 9 and 10) or Aggravated Penetrative Sexual Assault (Sections 5 and 6) may also be invoked. 

In addition, relevant provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS) concerning sexual offences against children may be attracted based on the evidence collected during the investigation. If allegations of threatening the victim’s family are substantiated, Section 351 of the BNS (Criminal Intimidation) may also become applicable. The case highlights the stringent legal framework available in India for the protection of children from sexual offences and for ensuring accountability of offenders.
