Police Register POCSO Case Against 25-Year-Old Woman in Kasaragod for Assaulting 16-Year-Old Girl

Police Register POCSO Case Against 25-Year-Old Woman in Kasaragod for Assaulting 16-Year-Old Girl

Kasaragod: The Kasaragod police have registered a case under the Protection of Children from Sexual Offences (POCSO) Act against a 25-year-old woman named Sneha Merlin. The case follows allegations that she assaulted a 16-year-old girl while the minor was asleep at her residence.

The accused is a repeat offender who already faces four active criminal cases. Last year, she was arrested in a separate incident involving the exploitation of a 12-year-old girl. That case came to light when a school teacher discovered suspicious footage on a mobile phone in the child’s bag and alerted Childline, leading to the child revealing the abuse during professional counselling.

Legal significance

Gender-Neutrality of POCSO: Unlike general adult sexual assault laws in India, which define the perpetrator as male, the POCSO Act is entirely gender-neutral. This case highlights that a female can be legally charged and prosecuted for the sexual assault of a child.

Impact of Recidivism: Because the accused has a documented history of targeting multiple minors, the legal system will treat her as a repeat offender. This classification drastically reduces the likelihood of bail and elevates the potential penalties to the highest statutory limits, including life imprisonment.

The Power of Mandatory Reporting: The history of the accused emphasizes the impact of strict reporting laws. The intervention of a school teacher and Childline in her previous offenses demonstrates how statutory mandatory reporting by educators serves as a critical mechanism to stop active child abuse.
