Sexual Assault of Minor Girl at Kochi Anganwadi; 20-Year-Old Arrested Confessed 

Kochi,Ernakulam: The arrested accused, identified as Kashinathan, on charges of sexually assaulting a minor girl, confessed the crime to police. The incident occurred at an anganwadi operating within the limits of the Kochi Corporation, which the suspect (the son of an anganwadi teacher/staff member) frequently visited. Following a complaint lodged by the toddler’s parents, a case was registered. The accused went into hiding but was subsequently tracked down and apprehended from a friend’s house in Aluva.  

In response to the incident, the Women and Child Development Department took strict administrative action. The minister ordered the immediate removal of the anganwadi staff for violating government directives that prohibit unauthorized outsiders from entering pre-school facilities. A high-level special investigation team, alongside the Child Welfare Committee (CWC), has initiated detailed inquiries into the safety lapse.

The case underscores the stringent framework of child protection legislation in India, primarily governed by the Protection of Children from Sexual Offences (POCSO) Act, 2012. Since the victim is a toddler, the criminal actions fall under the severe categories of sexual abuse prescribed by the Act. Specifically, offenses of this nature invoke Section 5 (Aggravated Penetrative Sexual Assault) or Section 9 (Aggravated Sexual Assault) of the POCSO Act, which carry enhanced punishments including rigorous life imprisonment or the death penalty when perpetrated against children under the age of separate thresholds or in positions of trust. Additionally, the actions cross-apply relevant punitive provisions under the Bharatiya Nyaya Sanhita (BNS), 2023 (which replaced the Indian Penal Code), regarding criminal assault on minors.  

Beyond individual criminal liability, the incident carries significant administrative law implications regarding the state’s duty of care in public educational and childcare institutions. The swift dismissal of the anganwadi staff highlights the legal accountability of public servants under institutional safety guidelines. By failing to enforce strict protocols against unauthorized entry, the staff breached their statutory duties under the Juvenile Justice (Care and Protection of Children) Act, 2015, which mandates a safe and secure environment for children. The subsequent interventions by the Child Welfare Committee (CWC) and the Nirbhaya Cell emphasize the legally binding oversight mechanisms designed to audit child care institutions and enforce systemic compliance.
