Supreme Court Rules on Domestic Violence Proceedings Arising From Kerala Case

The Supreme Court ruled in a case arising from proceedings initiated under the Protection of Women from Domestic Violence Act after the Kerala High Court had considered the matter. The Court held that where a wife had voluntarily waived monetary claims in a matrimonial settlement, those waived claims could not subsequently be revived through DV Act proceedings. The Court also clarified that the adult daughter’s independent rights were not extinguished because she was not a party to the settlement.
